    Default Question about zoning and airspace....

    I often times hear people discussing zoning requriments and air space rights that apply to certain building projects. Can someone please explain to me who/how establishes these parameters.

    Zoning guidelines is established by a division of the city called: City Planning. They determine what neighborhoods can build, how high they could build, and among other things. They, however, do not enforce zoning. They Department of Buildings enforces the zoning guildlines put out by City Planning.

    Zoning is created to ensure construction order in NYC. Without zoning requirements, developers would be building skyscrapers in every neighborhood in NYC. That is why you'd notice a lot of buildings in NYC is 6 stories or less, anything higher than that is considered a high rise and probably not permitted in that neighborhood.

    As for air rights....I have no clue.
